Whren v. United States

Whren v. United States (1996) established that a brief detention of a motorist for a minor traffic violation to investigate a more serious crime for which the officer has no reasonable suspicion or probable cause at the time the stop is initiated (i.e., “pretext stops”) do not violate the Fourth Amendment prohibition against unreasonable searches and seizures.

The Court held that the constitutional analysis focuses on the objective legality of the stop rather than the officer’s personal reasons for initiating the stop.
